1.1  This Privacy Policy applies to all personal information collected by Abbato Pty Ltd (ABN 41 338 465 108) trading as Visual Insights People, in connection with the operation of its website (www.VisualInsights.com.au) and the sale and delivery of its Evaluation Games & Online Courses training packages.

1.2  For purchasers based in Australia, this Policy is made in accordance with the Privacy Act 1988 (Cth) (“Privacy Act”) and the Australian Privacy Principles (APPs) contained in Schedule 1 of that Act.

 

1.3  For purchasers based in the European Economic Area (EEA) or the United Kingdom, we handle personal information in a manner consistent with the General Data Protection Regulation (GDPR) and the UK GDPR to the extent those instruments apply to us.

 

1.4  By purchasing a Training Package or using our website, you consent to the collection and handling of your personal information as described in this Policy. If you do not agree with this Policy, you should not make a purchase or use our services.

 

1.5  This Policy forms part of, and should be read together with, our Training Package Agreement.

2. What Personal Information We Collect

2.1  We collect personal information that is reasonably necessary to provide our training products and services. The types of personal information we may collect include:

  • Identity and contact information: your name, email address, and any other contact details you provide when making a purchase or contacting us;

  • Transaction information: details of the Training Package purchased, the date and amount of purchase, and payment method (noting that full card details are processed and held by eWAY, our third-party payment processor, not by us);

  • Account and access information: login credentials, access activity, course progress, assessment results, and completion records on the learning platform through which the Training Package is delivered;

  • Communication records: messages, queries, or feedback you send to us by email or through any platform communication tool; and

  • Technical data: IP address, browser type, and device information, collected automatically when you visit our website or access course content.

 

2.2  We do not collect sensitive information (such as health, financial, or biometric information) except where you have voluntarily provided it in communication with us, and we will handle any such information with additional care.

 

2.3  Where practicable, we will only collect personal information directly from you. We may also collect information from third-party platforms (such as payment processors or course hosting platforms) where necessary to administer your purchase.

3. How We Use Your Personal Information

3.1  We use personal information we collect for the following purposes:

  • Processing your purchase and administering your Training Package Agreement;

  • Delivering and managing your access to the Training Package, including issuing any certificates or credentials upon completion;

  • Communicating with you about your purchase, course access, updates, or any queries you raise;

  • Sending you administrative notices and policy updates relevant to your Training Package;

  • Improving our products, services, course content, and website (including through analysis of aggregated usage data);

  • Complying with our legal obligations, including tax, record-keeping, and consumer law requirements; and

  • Protecting the rights and interests of Visual Insights People, including in the case of a breach of the Training Package Agreement.

 

3.2  We will not use your personal information for direct marketing without your prior consent. If you have provided consent to receive marketing communications, you may withdraw that consent at any time by contacting us at admin@visualinsights.com.au or using any unsubscribe mechanism provided.

 

3.3  We will not use your personal information for purposes that are unrelated to those described in this Policy without first obtaining your consent or as otherwise permitted by law.

4. Disclosure of Personal Information

4.1  We do not sell your personal information to third parties.

4.2  We may disclose your personal information to trusted third-party service providers who assist us in operating our business and delivering our Training Packages, including:

  • eWAY (operated by Abbato Pty Ltd’s payment gateway provider, a subsidiary of Global Payments, Inc.), which processes online credit card and payment transactions on our behalf using bank-grade, PCI DSS Level 1 compliant infrastructure. eWAY’s own Privacy Policy is available at www.eway.com.au and governs the handling of payment data by eWAY directly;

  • Online learning platform providers who host and deliver course content;

  • Email and communication service providers used to send transactional or administrative communications; and

  • Technology and IT support providers who assist with our website and systems.

 

4.3  These third parties are permitted to use your information only to the extent necessary to provide services to us, and we take reasonable steps to ensure they handle your information in a manner consistent with applicable privacy law.

 

4.4  You should be aware that eWAY is a subsidiary of Global Payments, Inc., a multinational company headquartered in the United States. As a result, payment transaction data processed through eWAY may be disclosed to, or accessible by, Global Payments’ subsidiaries and affiliates located outside Australia, including in the United States. By completing a purchase, you consent to this overseas disclosure. We take reasonable steps to ensure eWAY handles such information in accordance with its obligations under applicable privacy law, including the Australian Privacy Principles.

 

4.5  We may disclose your personal information where required or authorised by law, including in response to a court order, subpoena, or regulatory request.

 

4.6  We will not otherwise disclose your personal information to any other third party without your consent.0

5. Storage and Security

5.1  We take reasonable steps to protect the personal information we hold from misuse, interference, and loss, and from unauthorised access, modification, or disclosure.

 

5.2  Your personal information may be stored on servers located in Australia or overseas (including through cloud-based platforms). Where information is stored or processed outside Australia, we take reasonable steps to ensure it is handled in a manner consistent with the Australian Privacy Principles or equivalent protections.

 

5.3  Notwithstanding clause 5.1, no method of transmission or storage is completely secure. We cannot guarantee the absolute security of personal information transmitted to us electronically.

 

5.4  We retain personal information for as long as is necessary to fulfil the purposes described in this Policy, and as required by applicable law. When personal information is no longer needed, we will take reasonable steps to destroy or de-identify it.

6. Accessing and Correcting Your Information

6.1  You have the right to request access to the personal information we hold about you, and to request that we correct any information that is inaccurate, incomplete, or out of date.

6.3  We may decline an access request in circumstances permitted by the Privacy Act, including where providing access would be unreasonable, or where the information relates to a legal matter. Where we decline a request, we will provide written reasons.

 

6.4  We do not charge a fee for making an access or correction request, though we may charge a reasonable fee to cover the administrative cost of providing access where this is permitted by law.

7. Additional Rights for EEA and UK Individuals

7.1  If you are located in the European Economic Area or the United Kingdom, you may have the following additional rights in relation to your personal information, subject to applicable law:

  • Right of erasure: you may request that we delete personal information we hold about you in certain circumstances;

  • Right to restriction: you may request that we restrict the processing of your personal information in certain circumstances;

10.3  If you are located in the EEA or UK and are not satisfied with our response, you may have the right to lodge a complaint with your local data protection authority.
